Welcome to EarthChasers! These Terms of Service ("Terms") govern your access to and use of the EarthChasers website (earthchasers.com) and services operated by WiseCreations Inc. ("we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our services.

2. Description of Service

EarthChasers is a free geography learning game that uses Google Maps 3D Photorealistic Tiles technology to create immersive map-based guessing games. Our service includes:

• Multiple game modes (Cities, Countries, Natural Wonders, Daily Hunt)
• 3D map exploration and visualization
• Custom map creation and sharing
• Game history tracking for registered users
• Leaderboards and community features
• Optional Pro subscription features

3. User Accounts

3.1 Account Creation

While you can play EarthChasers without an account, creating an account allows you to save game progress, create custom maps, and participate in leaderboards. When you create an account, you must provide accurate and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. User Conduct and Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any local, state, national, or international law
• Harass, abuse, or harm other users
• Upload or create content that is offensive, discriminatory, or violates others' rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scripts) to access the service without our permission
• Reverse engineer, decompile, or disassemble any part of our service
• Remove, modify, or obscure any copyright, trademark, or other proprietary notices
• Interfere with or disrupt the service or servers
• Collect or harvest personal information of other users
• Create custom maps with inappropriate, offensive, or copyrighted content

5. User-Generated Content

5.1 Custom Maps

Users with accounts may create and share custom maps. You retain ownership of the content you create, but by sharing custom maps on EarthChasers, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as part of our service.

5.2 Content Moderation

We reserve the right to review, moderate, or remove any user-generated content that violates these Terms, our content guidelines, or is otherwise objectionable. We do not pre-screen content but may remove it at any time.

5.3 Content Guidelines

User-generated content must not:

• Violate any third-party intellectual property rights
• Contain explicit, offensive, or inappropriate material
• Promote illegal activities or violence
• Include personal information of others without consent
• Be misleading or deceptive

6. Intellectual Property Rights

6.1 Our Content

All content on EarthChasers, including but not limited to text, graphics, logos, software, and game mechanics, is the property of WiseCreations Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Services

We use Google Maps Platform services, which are subject to Google Maps Platform Terms of Service. By using our service, you also agree to comply with Google's terms.

6.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our service for personal, non-commercial purposes in accordance with these Terms.

7. Subscriptions and Payments

7.1 Free Service

EarthChasers is free to use with unlimited gameplay. No payment is required to access core features.

7.2 Pro Subscription

We offer an optional Pro subscription with additional features. Subscription fees are charged through Stripe and are subject to the pricing displayed at the time of purchase.

7.3 Billing and Cancellation

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. No refunds are provided for partial subscription periods.

7.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will not affect current subscribers until their next renewal period, and we will provide advance notice of any changes.

8. Advertising

Our website displays advertisements through Google AdSense. These ads help support our free service. You may see personalized advertisements based on your interests and browsing activity.

You can manage your advertising preferences and opt out of personalized ads through Google Ads Settings.

9. Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• The results obtained from using the service will be accurate or reliable
• Any errors in the service will be corrected
• The service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISECREATIONS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless WiseCreations Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Your user-generated content

12. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of our service at any time without notice. We may also modify these Terms from time to time. Continued use of the service after changes constitutes acceptance of the modified Terms.

Material changes will be announced on our website or via email to registered users.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Vancouver, British Columbia, Canada, except that either party may seek injunctive relief in court if necessary.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WiseCreations Inc. regarding the use of our service and supersede any prior agreements.
